Welcome to MagicLine. These Terms of Service ("Terms") govern your access to and use of the MagicLine platform, including our website, applications, APIs, AI agents, telephony services, and related tools (collectively, the "Services").
The Services are operated by TaraAI LLC ("MagicLine", "Company", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
1. Description of Services
MagicLine provides AI-powered communication tools designed to help businesses manage phone calls, messages, and customer communications. The Services may include, but are not limited to:
- AI-powered call answering and call routing
- AI receptionist and conversational agents
- Call transcription and summaries
- Automated call handling
- Voicemail transcription
- SMS and messaging tools
- Temporary or dedicated phone numbers
- Call analytics and communication insights
- Integrations with third-party services
MagicLine acts as a software platform that enables businesses to manage communications. MagicLine is not a telecommunications carrier, and telephony connectivity may be provided through third-party providers.
2. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent that:
- you have the legal authority to enter into this agreement
- you are using the Services on behalf of a business or organization
- you will comply with all applicable laws and regulations
3. Customer Responsibility for Communications
You are solely responsible for all communications sent, initiated, or handled using the Services. You agree that you will comply with all applicable laws and regulations, including but not limited to:
- Telephone Consumer Protection Act (TCPA)
- Telemarketing laws
- Robocall regulations
- Call recording consent laws
- Do Not Call regulations
- Consumer protection and privacy laws
MagicLine does not originate calls on your behalf unless configured by you. MagicLine does not monitor or review communications created by customers. The Company does not determine the content, recipients, timing, or purpose of communications initiated using the Services. Customers are solely responsible for ensuring that all communications comply with applicable laws, including obtaining any required prior express consent.
4. Messaging Compliance
Customers using SMS or messaging features must comply with all applicable messaging regulations and industry guidelines, including but not limited to TCPA, CTIA Messaging Principles, and carrier policies. Customers must obtain proper consent before sending messages and must honor opt-out requests such as STOP or similar commands.
5. Acceptable Use
You agree not to use the Services to:
- Conduct illegal telemarketing or robocalling
- Engage in high-volume automated calling without consent
- Contact individuals without required consent
- Transmit fraudulent, misleading, or deceptive communications
- Impersonate individuals or organizations
- Spoof caller ID
- Engage in unlawful call recording
- Harass, threaten, or abuse others
- Violate any applicable law or regulation
MagicLine reserves the right to suspend or terminate accounts that violate these rules.
6. AI-Generated Content
Some features of the Services use artificial intelligence to generate responses, summaries, or automated interactions. AI-generated outputs:
- may contain inaccuracies
- should be reviewed before relying on them
- do not constitute legal, financial, or professional advice
MagicLine does not guarantee the accuracy or reliability of AI-generated content. Users are responsible for disclosing when an interaction involves an automated system where required by law (for example, certain jurisdictions may require disclosure such as "This call may be handled by an automated assistant").
7. Third-Party Services
The Services may rely on third-party providers, including:
- Telecommunication providers
- SMS delivery providers
- Cloud infrastructure providers
- Artificial intelligence services
MagicLine is not responsible for interruptions or failures caused by third-party providers.
8. Phone Numbers and Communications Infrastructure
MagicLine may provide access to phone numbers or messaging capabilities through third-party carriers. Availability of phone numbers is not guaranteed. Phone numbers may be reclaimed or reassigned if:
- your account is inactive
- required regulatory information is not provided
- services are suspended or terminated
9. Payment and Subscription
Some features of the Services require payment or subscription. By subscribing to a paid plan you agree to:
- pay all applicable fees
- keep your billing information accurate
- authorize recurring payments when applicable
Fees are generally non-refundable, except where required by law. MagicLine may change pricing with reasonable notice.
10. Account Suspension or Termination
MagicLine may suspend or terminate your access to the Services if:
- you violate these Terms
- your use creates legal or regulatory risk
- payment obligations are not met
- fraudulent or abusive activity is detected
You may stop using the Services at any time.
11. Disclaimer of Warranties
The Services are provided "as is" and "as available." MagicLine makes no warranties regarding:
- uninterrupted service
- error-free operation
- specific business results
To the fullest extent permitted by law, we disclaim all warranties, express or implied.
12. Limitation of Liability
To the maximum extent permitted by law, MagicLine shall not be liable for:
- indirect or consequential damages
- loss of business or profits
- loss of data
- regulatory penalties incurred by users
Our total liability shall not exceed the amount paid by you to MagicLine in the previous 12 months.
13. Indemnification
You agree to indemnify and hold harmless MagicLine and its affiliates from any claims, damages, or legal expenses arising from:
- your use of the Services
- communications initiated using your account
- violations of law or regulation
14. Changes to the Terms
We may update these Terms from time to time. Updated versions will be posted on this page with a revised "Last Updated" date. Continued use of the Services after updates constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.
